INTERNETO LINIJA Service Conditions Of AB DNB Bankas

 1. Definitions

1.1. The INTERNETO LINIJA shall mean the Bank‘s on-line customer service system (www.i-linija.lt)

1.2. The Bank shall mean AB DNB Bankas.

1.3. The Customer shall mean a person who has concluded the agreement with the Bank.

1.4. The Agreement shall mean an agreement on use of the INTERNETO LINIJA, concluded between the Bank and the Customer.

1.5. PIN shall mean a personal identity number.

1.6. TAN shall mean a transaction authorisation number.

1.7. The Password generator shall mean an identification tool (electronic device) which under the special algorithm generates a unique password every time upon registration in the system and/or performing operations therein, and/or making transactions.

1.8. Service conditions shall mean these INTERNETO LINIJA service conditions.

1.9. The Account shall mean the Customer’s account (-s) or deposit (-s) opened with the Bank that can be handled by Customer through the INTERNETO LINIJA upon concluding the Agreement.

1.10. General rules shall mean the general rules for providing the Bank‘s services, which are applied to the agreements between the Bank and the Customer regarding provision of the Bank‘s services to the Customer.

1.11. In the Agreement and the Service Conditions the Customer and the Bank may be jointly referred to as the parties and separately as the party.

2. Use of INTERNETO LINIJA

2.1. The Customer shall have the possibility to use the INTERNETO LINIJA upon concluding the Agreement with the Bank, coordinating the list of Accounts that will be handled electronically and persons who each separately or only jointly can use the INTERNETO LINIJA, and receives from the Bank the user identification code (hereinafter referred to as the Account Manager); password which can be changed by the Customer at his/her choice; card of PIN codes, table of TAN codes for execution of operation at the Customer’s request; password generator. If the Bank delivers the Password generator to the Customer, tables of PIN and TAN codes are not additionally given to the Customer, and vice versa.

2.2. While using the INTERNETO LINIJA the payment orders sent by the Customer shall be accepted in the Bank until the end of the Bank’s workday set by the Bank. In case the hours when payment orders are accepted are changed, the Bank shall inform the customer thereabout through the INTERNETO LINIJA.

2.3. The Customer shall undertake not to duplicate the payment orders submitted to the Bank through the INTERNETO LINIJA in other ways. The Customer may cancel the payment order only until the moment of execution of the payment order, i.e. as long as the INTERNETO LINIJA gives option to delete the payment order. In case the Bank informs the Customer by a separate notification about the possibility to correct payment orders submitted to the Bank by using the INTERNETO LINIJA, every Account Manager who is eligible to dispose funds within the Account shall be eligible to correct the payment order in accordance with the deadlines set by the Bank irrespective of the fact whether the this particular Account Manager is eligible to dispose funds within the Account alone or together with the other Account Managers. Only the data indicated by the Bank may be corrected in the payment order. Upon failure to submit the correction within the deadlines set by the Bank, the payment order shall be cancelled.

2.4. By using the INTERNETO LINIJA, the Customer may conclude deals with the Bank set by the Bank. The Bank shall be entitled to unilaterally terminate the opportunity to conclude all or part of the deals through the INTERNETO LINIJA or to provide for other requirements.

2.5. The Bank shall undertake to consult the Customer on issues related to the INTERNETO LINIJA.

2.6. Transactions under this agreement shall be executed after the Customer fills in the INTERNETO LINIJA form set by the Bank and confirms the fact of offer to make the transaction by TAN code or the unique password (a sequence of figures) generated by the Password generator and under presence of other conditions set by the Bank. The Bank shall inform the Customer on accepting of the offer through the INTERNETO LINIJA. This does not mean that the Bank in any case must accept the Customer’s offer or inform the Customer about the acceptance of the offer by separate notice.  

2.7. By using the INTERNETO LINIJA, the party may provide notifications and information to the other party. In the cases provided by the Bank, the Customer must register the notifications sent through the INTERNETO LINIJA by filling in the form set by the Bank.

2.8. The Customer and the Bank agree that the payment orders, notifications sent through the INTERNETO LINIJA or transactions made have a legal power equal to written payment orders, notifications and transactions.

2.9. Before using the Password generator the Customer shall get familiar with the Password generator’s instruction which is available to public in the website of the Bank www.dnb.lt.

3. Security of INTERNETO LINIJA and suspending of service providing

3.1. In case the Customer three times enters an incorrect PIN, TAN code, password or the password generated by the Password generator as well as upon the Customer’s request, the Bank shall undertake to immediately suspend the INTERNETO LINIJA service. The Bank shall renew the INTERNETO LINIJA service only upon the Customer’s arrival at the Bank and submitting a written request.

3.2. In case of the threat that the user’s identification code, password, Password generator’s security password (PIN), password generated by the Password generator, PIN or TAN codes may become ore have become known to third parties, the Password generator is lost (hereinafter referred to as lost), the Customer or the Account Manager must immediately inform the Bank thereabout in writing or by telephone No. 1608.

3.3.The Bank shall also be entitled without any negative consequences to the Bank not to execute the Customer’s payment orders or to suspend the INTERNETO LINIJA service due to technical disturbances which may harm the INTERNETO LINIJA or the Customer, or in case of the threat that the INTERNETO LINIJA may be used by other person than the Customer, in case the payment orders are not registered following the INTERNETO LINIJA requirements, in case the funds in the Customer’s account are not sufficient to make all payments, or in case it is not possible to execute the payments received from the Customer due to other important reasons including the guarantee of the INTERNETO LINIJA security. The Bank shall inform the Customer thereabout. In such case the service providing shall be renewed by the decision of the Bank.

4. Liability

4.1. The Bank shall not be liable for the following:  

4.1.1. Changing of the Customer‘s data transferred through the ITERNETO LINIJA which was done before this data actually reached the Bank;

4.1.2. Veracity of the data transferred through the INTERNETO LINIJA;

4.1.3. Losses which occurred due to disclosing of the user identification code, password, Password generator’s security password (PIN), password generated by the Password generator, PIN or TAN codes of the Customer or Account Manager to the third persons, including other Account Managers or other representatives of the Customer provided that this was not done by the Bank;

4.1.4. Losses which occurred due to the fact that the payment orders submitted through the INTERNETO LINIJA were duplicated by the Customer in other ways.

4.2. The Customer shall be liable for the correctness of the data sent to the Bank through the INTERNETO LINIJA, including the provision of the correct identification data of the payee, his accounts and the payee’s bank.

4.3. The Bank shall not be liable if the Customer or Account Manager is not able to use the INTERNETO LINIJA due to failures in the telecommunication networks or if the information was lost or distorted due to failures in the telecommunication networks.

4.4. The Customer shall bear the losses to disclosure, loss of the user identification code, password, Password generator, Password generator’s security password (PIN), password generated by the Password generator, PIN or TAN codes or to incompliance with Customer’s obligations specified in the Agreement.

4.5. The losses which occurred after the moment of providing the Bank with the notification provided by paragraph 3.2 of these Service Conditions, except for the cases when the losses occurred due to the intention or gross negligence of the Customer or Account Managers, shall be compensated by the Bank.

4.6. Following paragraph 4.4 of the Service Conditions, the amount of the losses of the Customer related to the lost user identification code, password, Password generator’s security password (PIN), password generated by the Password generator, PIN or TAN codes occurring before the moment of providing the Bank with the notification set by paragraph 3.2 of these Service Conditions shall not exceed EUR 150 equivalent in the national currency of the Republic of Lithuania. In case the losses occurred due to the intention or gross negligence of the Customer or Account Managers, the limit of the Customer’s losses amounting to EUR 150 equivalent in the national currency of the Republic of Lithuania shall not be applied. In case the losses occurred upon using the password, user identification code, PIN codes or TAN codes, passwords generated by the Password generator or due to incompliance with the provisions of this Agreement, in all cases it shall be considered that the losses occurred due to the intention or gross negligence of the Customer or Account Manager, unless otherwise proved by the Customer.

5. Amending of the Service Conditions

5.1. The Service Conditions shall be amended and supplemented following the procedure set by the General Rules. The Customer shall be informed about amendments or supplements to the Service Conditions through the INTERNETO LINIJA.
